Changes to Australia’s vaping laws

Australia has recently implemented significant changes to its vaping laws, with the aim of reducing the increasing prevalence of vaping, particularly among young people.  

As part of a nationwide effort to curb vaping, the Australian government has introduced stricter regulations on the importation and sale of vaping products coming into effect from July 1, 2024.

Key changes include:

  • Prescription Requirement for Nicotine Vapes: Nicotine vaping products can only be legally purchased in Australia with a doctor’s prescription. This measure was introduced to control the distribution of nicotine vapes, which were previously accessible through online retailers and informal channels.
  • Ban on Non-Prescription Vaping Products: The importation of nicotine vaping products for personal use without a prescription is now illegal.
  • Increased Enforcement and Penalties: The government has introduced increased penalties for those found to be selling or distributing nicotine vaping products without the necessary approvals.

Impact on Victorians

These national changes have a direct impact on Victorians who vape or are considering vaping. In addition to the federal regulations, Victoria has its own specific laws regarding vaping:

  • Smoke-Free Zones: In Victoria, vaping is banned in the same areas where smoking is prohibited, including indoor workplaces, public transport, and areas within 4 meters of public building entrances.
  • Sale Restrictions: The sale of vaping products, including non-nicotine vapes, is restricted to individuals over the age of 18. Retailers must also comply with strict packaging and advertising regulations.

It’s essential to be aware of these changes and how they may affect your access to vaping products. If you use nicotine vapes, you will need to consult with a healthcare provider to obtain a prescription.
